Licensing and IP

The mark is the asset. Everything else is execution.

KRATOS is a registered figurative trade mark held by the proprietor and licensed under a written agreement of unlimited duration. Manufacturing, distribution and market registration all sit downstream of that licence, which is what allows the brand to move between partners without moving the brand itself.

How a licence runs.

Proprietor

The mark is held by the registered proprietor, not by an operating company. Nothing in the trading structure below can encumber it.

Licence

A written licence of unlimited duration grants the right to manufacture, distribute and sell under the mark. The licence sets the standard: recipe, specification, artwork, label declarations and the conditions under which the mark may appear.

Territory rights

Distribution rights are granted by territory and by product line. A partner holding beverages in one region does not by that fact hold nicotine, and a partner holding one country does not by that fact hold the region.

Manufacturing

Contract manufacturers produce to specification under the licence. They hold no rights in the mark and no authority to appoint distributors, register products in their own name, or extend the range.

Artwork

All artwork, the wordmark, the device and the brand assets remain the property of the proprietor. Local adaptation for regulatory purposes is approved in writing before print.

03  /  Enforcement

The mark is defended.

Unauthorised use of the KRATOS name, the wordmark, the device, or transliterations and close variants of them is reported and pursued in every market where the mark is registered. That includes packaging that imitates the trade dress, listings on marketplaces and social commerce, and domain registrations trading on the name.

If you have seen a product you believe is not ours, or a listing using our name without authority, send it to ip@kratosbrands.com with a photograph, the location and the date. Reports are actioned.

Applying for a licence.

Licensing and territory enquiries go to licensing@kratosbrands.com. To be assessed quickly, include:

  • The company, its registration number and the territory applied for
  • The product lines of interest, by brand
  • Existing distribution: categories carried, retail accounts held, cold chain if relevant
  • Import and product registration capability in that territory
  • Indicative first year volume

Applications without a named territory and an existing route to retail are not assessed.
